Chapter 16 - Elena Takes the Stand

Elena Ashford entered the courtroom through a television screen.
The trial began nine months after Adrian's arrest.
By then the winter garden was green, Zuri was four, and Naomi had learned how to walk past reporters without lowering her head.
Adrian looked older.
He also looked confident.
His attorney, Marcus Bell, told the jury the case was built from grief, bargains, and corrupted memories.
"Victor Hale is a confessed criminal. Tessa Hale is a traumatized accuser. Damon Ashford admits he failed his wife. The prosecution wants you to turn regret into murder."
Shaw did not react.
She called the records first.
Bank transfers.
Security deletions.
Hidden microphones.
Payments to contractors.
Then Maria Reyes testified about the hospital.
Then Harold Penn admitted suppressing Elena's request to address the board.
Then Tessa took the stand.
Naomi sat behind her.
Damon sat across the aisle.
Tessa described the assault without dramatics.
She described the pregnancy.
Elena's help.
Adrian's threats.
Her father's cowardice.
When Bell cross-examined her, he held up years of mental health records.
"You have been diagnosed with post-traumatic stress disorder?"
"Yes."
"Depression?"
"Yes."
"Panic disorder?"
"Yes."
"So your memory can be affected by trauma."
Tessa looked at the jury.
"My sleep is affected by trauma. My appetite is affected by trauma. My memory of the man who assaulted me is not."
Bell changed direction.
"You accepted financial support from Mr. Vale."
"I accepted money because he threatened me."
"Or because the relationship was consensual."
"No."
Bell pushed.
Tessa did not break.
When she stepped down, Naomi met her at the courtroom door.
"You did it."
Tessa exhaled.
"I hated every second."
"Still did it."
Victor testified next.
The courtroom changed when he entered.
Tessa did not look at him.
Naomi did.
Victor admitted ordering the contractor to damage Elena's tire assembly after Adrian said she could not reach the board.
He admitted helping fabricate the theft case against Isaiah.
Then Shaw asked the question Naomi had waited years to hear.
"Did Adrian Vale know you intended to stop Isaiah Carter from speaking?"
Victor stared at Adrian.
"Yes."
"How?"
"I told him Isaiah still had copies."
"What did Mr. Vale say?"
Victor swallowed.
"He said, 'Then make sure he stops being a problem.'"
Bell objected.
Overruled.
Victor continued.
"I arranged for a mechanic to loosen Isaiah's steering linkage."
Naomi's hand closed around Damon's.
Neither noticed until afterward.
Shaw asked, "Why are you telling the truth now?"
Victor looked toward Tessa.
"Because I kept calling cowardice protection."
The sentence landed across the courtroom.
Adrian's face remained unreadable.
On the fourth day, Shaw played Elena's video.
Damon had dreaded it for months.
On screen, Elena stood in the unfinished garden.
"If you're seeing this, I either succeeded or I didn't."
The jury watched her explain Halcyon, Tessa, Victor, and Adrian.
Then came the part Damon had memorized.
"Damon, I know you will want to believe there is another explanation."
He stared at the floor.
Naomi's hand rested beside his.
This time she deliberately moved it closer.
Not touching.
Available.
Elena finished.
"I am not asking you to avenge me. I am asking you to listen."
The screen went dark.
No one moved for several seconds.
Bell stood.
"Your Honor, we renew our objection. Mrs. Ashford cannot be cross-examined."
The judge instructed the jury carefully about how they could consider the recording.
Facts had rules.
Grief did not.
During recess, Damon went alone to an empty hallway.
Adrian's mother found him there.
Margaret Vale was Elena's aunt.
She had not spoken to Damon since the arrest.
"He says you destroyed him," she said.
Damon looked at her.
"No."
"You're testifying tomorrow."
"Yes."
"Against family."
Damon almost smiled at the old word.
"Elena was family."
Margaret flinched.
"So is Adrian."
"Family isn't immunity."
She began crying.
"He was always jealous of you."
Damon waited.
"Your grandfather gave you everything. Adrian spent his whole life proving he belonged."
"Did you know about Halcyon?"
"No."
"Tessa?"
Margaret looked away.
Damon's voice changed.
"Did you know?"
"I knew there had been a complaint."
"And?"
"Adrian said she wanted money."
Damon closed his eyes.
There it was again.
Another person had heard a warning and chosen the easier story.
Margaret whispered, "What was I supposed to do?"
Damon looked at her.
"Listen."
She left without another word.
The next morning, Damon took the stand.
Bell attacked him immediately.
"You ignored your wife when she raised concerns."
"Yes."
"You described her as paranoid."
"Yes."
"You walked away from an argument between her and my client."
"Yes."
"Then isn't it true that you are using this prosecution to cleanse your own guilt?"
Damon looked at the jury.
"No."
"Why not?"
"Because guilt doesn't become clean when someone else is convicted."
Bell paused.
Damon continued.
"I failed Elena. That is true whether Adrian is guilty or innocent. I don't need this jury to change my past."
"Then what do you need?"
"Nothing."
He looked at Adrian.
May you like
"This trial isn't for me."
For the first time, Adrian looked uncertain.
